1. Acceptance of Terms

By accessing and using the MetalMasters website or services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Overview

MetalMasters provides precision metal fabrication services including:

  • TIG Welding (Aluminum, Stainless Steel, Steel, Titanium)
  • CNC Machining (2-axis and 3-axis milling)
  • Lathe Machining (Precision turning operations)
  • Mandrel Tube Bending (Up to 2" OD)
  • CAD Engineering Design Services
  • Inspection Services

3. Quote Requests and Estimates

3.1 Quote Validity

  • All quotes are valid for 30 days from the date of issue
  • Quotes are subject to change based on material costs, specifications, or project scope
  • Final pricing will be confirmed before work begins

3.2 Quote Accuracy

  • Quotes are based on the information provided by the customer
  • Inaccurate or incomplete specifications may result in pricing adjustments
  • Customer is responsible for providing accurate CAD files, drawings, and specifications

4. Project Specifications and Changes

4.1 Specification Requirements

  • Customer must provide complete technical specifications, drawings, or CAD files
  • Tolerances must be clearly specified (default: ±0.005" unless otherwise noted)
  • Material specifications, finishes, and quality standards must be documented

4.2 Change Orders

  • Any changes to approved specifications must be submitted in writing
  • Change orders may affect pricing, timeline, and deliverables
  • MetalMasters will provide revised quotes for change orders before proceeding

5. Payment Terms

5.1 Payment Schedule

  • New Customers: 50% deposit required to begin work, balance due upon completion
  • Established Customers: Net 30 payment terms available with approved credit
  • Large Projects: Custom payment schedules may be arranged

5.2 Late Payments

  • Late fees of 1.5% per month (18% APR) apply to overdue balances
  • Work may be suspended for accounts more than 30 days overdue
  • Customer is responsible for all collection costs including legal fees

5.3 Accepted Payment Methods

  • Check or Money Order
  • Bank Transfer/Wire Transfer
  • Credit Card (processing fees may apply)
  • Cash

6. Lead Times and Delivery

6.1 Estimated Lead Times

  • Lead times are estimates and not guarantees
  • Typical lead times: 2-4 weeks for standard projects
  • Rush services available for additional fees
  • Complex or large projects may require extended timelines

6.2 Delays

  • MetalMasters is not liable for delays caused by customer-provided materials, specifications, or approvals
  • Force majeure events (natural disasters, pandemics, supplier delays) may extend timelines
  • Customers will be notified promptly of any anticipated delays

7. Quality Standards and Tolerances

7.1 Manufacturing Standards

  • CNC Machining: ±0.001" tolerance on critical dimensions
  • TIG Welding: AWS D1.1/D1.2 standards or as specified
  • Tube Bending: Minimal deformation, smooth bends without kinking
  • Inspection: Available upon request

7.2 Inspection and Testing

  • All parts are inspected before delivery
  • Customer may request inspection reports for additional fee
  • Third-party inspection available at customer's expense

8. Warranty and Liability

8.1 Workmanship Warranty

  • MetalMasters warrants workmanship for 90 days from delivery
  • Warranty covers manufacturing defects and workmanship errors
  • Warranty does not cover normal wear, misuse, or modifications

8.2 Limitation of Liability

  • MetalMasters' liability is limited to the cost of the fabricated parts
  • We are not liable for consequential, incidental, or special damages
  • Customer assumes all risks for design suitability and end-use application
  • Maximum liability shall not exceed the total project cost

9. Material Ownership and Storage

9.1 Customer-Provided Materials

  • Customer retains ownership of provided materials until incorporated into finished product
  • MetalMasters is not responsible for damage to defective customer-provided materials
  • Additional materials may be purchased by MetalMasters with customer approval

9.2 Completed Work Storage

  • Completed parts held for more than 30 days may incur storage fees
  • Parts not picked up within 90 days may be disposed of or sold to recover costs
  • Customer will be notified before disposal

10. Intellectual Property

10.1 Customer Designs

  • Customer retains ownership of all designs, CAD files, and specifications
  • MetalMasters will not reproduce customer designs for third parties without written consent
  • Customer grants MetalMasters license to use designs solely for manufacturing purposes

10.2 Portfolio Use

  • MetalMasters may photograph completed work for portfolio and marketing purposes
  • Proprietary or confidential designs will not be disclosed
  • Customer may request exclusion from portfolio at any time

11. Cancellation and Returns

11.1 Order Cancellation

  • Orders may be cancelled before work begins with full refund of deposit
  • Cancellations after work has started are subject to fees for work completed and materials purchased
  • Custom or non-standard parts are non-refundable once production begins

11.2 Returns and Exchanges

  • Returns accepted within 14 days if parts do not meet specifications
  • Customer must provide written documentation of non-conformance
  • MetalMasters will repair, replace, or refund at our discretion
  • Customer is responsible for return shipping unless parts are defective

12. Confidentiality

  • MetalMasters respects customer confidentiality and proprietary information
  • Non-Disclosure Agreements (NDAs) available upon request
  • All customer data, designs, and specifications are kept confidential
  • Employees and subcontractors are bound by confidentiality obligations

13. Dispute Resolution

13.1 Informal Resolution

  • Parties agree to attempt good-faith negotiation before formal proceedings
  • Disputes should be reported to rpmetalmasters@gmail.com within 30 days

13.2 Binding Arbitration

  • If informal resolution fails, disputes will be resolved through binding arbitration
  • Arbitration conducted under the American Arbitration Association (AAA) rules
  • Arbitration location: Denver, Colorado
  • Each party bears their own legal costs

14. Governing Law

  • These Terms are governed by the laws of the State of Colorado, USA
  • Exclusive jurisdiction: Courts of Denver County, Colorado
  • Federal laws apply where applicable (e.g., intellectual property, interstate commerce)

15. Modifications to Terms

  • MetalMasters reserves the right to modify these Terms at any time
  • Updated Terms will be posted on our website with revision date
  • Continued use of services constitutes acceptance of updated Terms
  • Material changes will be communicated via email when possible
